New Bill Known As Enemy Expatriation Act Would Allow Government To Strip Citizenship Without Conviction

First, Congress considered the National Defense Authorization Act, sections of which gave the President the authority to use the military to arrest and indefinitely detain Americans without trial or charge. The language was revised because of strong condemnation from the American people. But now a new bill has emerged that poses yet another threat to the American citizenry.

Congress is considering HR 3166 and S. 1698 also known as the Enemy Expatriation Act, sponsored by Joe Lieberman (I-CT) and Charles Dent (R-PA). This bill would give the US government the power to strip Americans of their citizenship without being convicted of being “hostile” against the United States. In other words, you can be stripped of your nationality for “engaging in, or purposefully and materially supporting, hostilities against the United States.” Legally, the term “hostilities” means any conflict subject to the laws of war but considering the fact that the War on Terror is a little ambiguous and encompassing, any action could be labeled as supporting terrorism. Since the Occupy movement began, conservatives have been trying to paint the protesters as terrorists.

The new law would change a part of US Code 1481 which can be read in full here. Compare 3166 to 1481 and the change is small. The new section makes no reference to being convicted as it does in section (7). So even though the language of the NDAA has been revised to exclude American citizens, the US government merely has to strip Americans of their citizenship and the NDAA will apply. And they will be able to do so without convicting the accused in a court of law.

White House Approves Bill Allowing Military To Imprison Americans Without Trial

Despite his promise to veto amendments within the National Defense Authorization Act (NDAA) President Obama said Wednesday he will approve the law allowing the U.S. military to arrest and hold anyone it deems a terrorist, even on American soil.

Phil Hirschkorn of CBS News reports the Obama administration abandoned its veto saying the final version of the bill had been “softened.” The minor adjustments to the wording now give the President power to issue a waiver of the military detention requirement and allow the White House to use its own judgment in putting the controls into place.

Lobbying Firm Prepares $850,000 Assault On Movement

A report was recently leaked from the lobbying firm Clark, Lytle, Geduldig, Cranfordintendedforoneofit’s WallStreet clients. They warn of the dangers of the Occupy Wall Street movement, and advise engaging in a public relations campaign to discredit the movement. They are demanding a price of $850,000 to engage in the misinformation campaign. This campaign will include researching activists’ financial histories and civil and criminal information, and monitoring social media. The first two paragraphs of the memo read: “Leading Democratic party strategists have begun to openly discuss the benefits of embracing the growing and increasingly organized Occupy Wall Street (OWS) movement to prevent Republican gains in Congress and the White House next year. We have seen this process of adopting extreme positions and movements to increase base voter turnout, including in the 2005-2006 immigration debate. This would mean more than just short-term discomfort for Wall Street firms. If vilifying the leading companies of this sector is allowed to become an unchallenged centerpiece of a coordinated Democratic campaign, it has the potential to have very long-lasting political, policy and financial impacts on the companies in the center of the bullseye. It shouldn’t be surprising that the Democratic party or even President Obama’s re-election team would campaign againstWallStreetinthiscycle. Howeverthebiggerconcernshouldbethat Republicans will no longer defend Wall Street companies—and might start running against them too.”

PERF, DHS, and FBI Help Plan Raids

The past few weeks have seen widespread and often times, strikingly similar brutal crackdowns on peaceful occupations across the country and the world. The question of possible behind the scenes coordination of these raids was quickly answered. The mayors of Oakland and Seattle admitted to participating in a conference call with 18 other mayors that was advised by liaisons from the Department of Homeland Security and the FBI. According to a justice official, some of the advice that was given by DHS and the FBI to local mayors included the use of a massive show of police force, including police in riot gear, as well as advice to conduct raids when press is least able to document police abuses. On 11/17, on DemocracyNow! the executive director of PERF (Police Executive Research Forum) Chuck Wexler, spoke in detail about the coordination that this organization did with police chiefs across the country prior to the crackdown. PERF is a private member lobbying organization restricted to the executive head of a municipal, county, or state funded agency that provides general police services. It’s board includes police chiefs in charge of crackdowns in Miami in 2003, DC throughout the lead-up to the Iraq War, and St. Paul during the 2008 RNC.

Police Cause Miscarriage

Jennifer Fox, 19, was pregnant at Occupy Seattle last week when Police broke up the encampment. She told officers she was pregnant and asked to be let go. They hit her in the stomach twice before pepper spraying her in the face. Fox miscarried on Sunday. Doctors told her that the baby was killed due to trauma from the attack as well as inhaling tear gas.

Occupy ICE

Motivated by recent ICE audits targeting union organizers, on 11/17, members of Occupy San Diego, joined members of a local janitor’s union and immigrant rights activists to launch “Occupy La Migra” or “Occupy ICE”. Hundreds of activists showed up to the demonstratoin organized by the SEIU USWW Janitors Union, and set up four tents outside the SD offices of Immigration and Customs Enforcement.

Occupy Homes

Across the country occupations are working to stave off pending evictions by occupying homes at risk of foreclosure when tenants enlist its support. In Minneapolis following the successful occupation of one woman’s home, occupiers moved to occupy a second home facing foreclosure. Policearrived and arrested two people, kicking the rest out of the house. More than 150 protesters returned to retake the house and stayed the night only to be evicted by 15 squad cars in the morning. Similar actions have cropped up all over the country. On Dec. 6, OWS will stand in solidarity for a national day of action on the foreclosure crisis.

Police Abuse Students

At the University of California-Davis on 11/18, students attempted to set up tents to protest rising tuition at the school. Under orders from the Chancellor of the college, police in riot gear moved in. Dozens of students locked arms and seated themselves around the tents. Police responded by spraying students with large amounts of pepper spray in the face and down student’s throats, hospitalizing several. On 11/21, two officers involved in the incident, were suspended without pay.

99% Deficit Proposal

This week, as members of Occupy the highway finished their trek from NYC to DC and the Congres- sional Super Committee admitted their failure to reach a deficit deal, Occupy DC released its own deficit reduction plan. West Coast Port Shutdown

In response to coordinated attacks on the oc cupations and attacks on workers across the nation, Occupy Oakland GA voted unanimously on 11/18 to call local occupations to mobilize to shutdown the ports of the entire West Coast on December 12th. Drawing comparisons between the recent police brutality against the Occupy movement and the union-busting and attacks on organized labor, Occupy Oakland is calling for solidarity with labor unions particularly the rupture of Lonshoreman jurisdiction in Longview Washington by EGT. These actions are meant to draw attention to and protest these attacks against organized labor. Los Angeles has already passed a resolution to carry out a port action at the Port of LA on December 12th, to shut down SSA terminals (which are owned by Goldman Sachs).
