Three Motions to Dismiss Brought in Minnesota DRE Lawsuit

Last Spring, various law enforcement agencies in Minnesota worked together on picking people up and administering drugs to them.  The video showing this activity got a lot of views on Youtube.com and made national and international news.  Video shown below.

As I have covered on this blog before, some of the people who were subject to this testing brought a lawsuit against those who ran and participated in the program.

Now the State of Minnesota, Ramsey County and the “City and County Defendants” have brought three motions to dismiss this lawsuit.  This blog post is not intended in any way to be an official response to these motions, but rather as a vehicle to share these motions with the public.  Here are links to each of the memorandums of law in support of the motions to dismiss:

Back in December of 1996, Jane Akre and her husband, Steve Wilson, were hired by FOX as a part of the Fox “Investigators” team at WTVT in Tampa Bay, Florida. In 1997 the team began work on a story about bovine growth hormone (BGH), a controversial substance manufactured by Monsanto Corporation. The couple produced a four-part series revealing that there were many health risks related to BGH and that Florida supermarket chains did little to avoid selling milk from cows treated with the hormone, despite assuring customers otherwise.

According to Akre and Wilson, the station was initially very excited about the series. But within a week, Fox executives and their attorneys wanted the reporters to use statements from Monsanto representatives that the reporters knew were false and to make other revisions to the story that were in direct conflict with the facts. Fox editors then tried to force Akre and Wilson to continue to produce the distorted story. When they refused and threatened to report Fox’s actions to the FCC, they were both fired.(Project Censored #12 1997)

Akre and Wilson sued the Fox station and on August 18, 2000, a Florida jury unanimously decided that Akre was wrongfully fired by Fox Television when she refused to broadcast (in the jury’s words) “a false, distorted or slanted story” about the widespread use of BGH in dairy cows. They further maintained that she deserved protection under Florida’s whistle blower law. Akre was awarded a $425,000 settlement. Inexplicably, however, the court decided that Steve Wilson, her partner in the case, was ruled not wronged by the same actions taken by FOX. Read the rest of this entry →

It Can Happen Here: The Banks Deposit Confiscation Scheme Planned for US and UK Depositors

Confiscating the customer deposits in Cyprus banks, it seems, was not a one-off, desperate idea of a few Eurozone “troika” officials scrambling to salvage their balance sheets. A joint paper by the US Federal Deposit Insurance Corporation and the Bank of England dated December 10, 2012, shows that these plans have been long in the making; that they originated with the G20 Financial Stability Board in Basel, Switzerland (discussed earlier here); and that the result will be to deliver clear title to the banks of depositor funds.

New Zealand has a similar directive, discussed in my last article here, indicating that this isn’t just an emergency measure for troubled Eurozone countries. New Zealand’s Voxy reported on March 19th:

The National Government [is] pushing a Cyprus-style solution to bank failure in New Zealand which will see small depositors lose some of their savings to fund big bank bailouts . . . .

Open Bank Resolution (OBR) is Finance Minister Bill English’s favoured option dealing with a major bank failure. If a bank fails under OBR, all depositors will have their savings reduced overnight to fund the bank’s bail out.

Ex-CNN Reporter: I Received Orders to Manipulate News to Demonize Syria and Iran

[Apparently, MSNBC and Faux got the same orders.]  Ex-CNN reporter Amber Lyon revealed that during her work for the channel she received orders to send false news and exclude some others which the US administration did not favor with the aim to create a public opinion in favor of launching an aggression on Iran and Syria. Lyon was quoted by the Slovak main news website as saying that the mainstream US media outlets intentionally work to create a propaganda against Iran to garner public opinion’s support for a military invasion against it. She revealed that the scenario used before launching the war on Iraq is being prepared to be repeated where Iran and Syria are now being subject to constant ‘demonization’.

New Sanders Bill Would Break Up Big Banks

‘If an institution is too big to fail, it is too big to exist’


U.S. Sen. Bernie Sanders (I-Vt.) said today he will introduce legislation to break up banks that have grown so big that the Justice Department has not pursued prosecutions for fear an indictment would harm the financial system.

The 10 largest banks in the United States are bigger now than before a taxpayer bailout following the 2008 financial crisis. At the time Congress, over Sanders’ objection, approved a $700 billion bank rescue because of concerns by some that the financial institutions were too big to fail. Another $16 trillion from the Federal Reserve propped up financial institutions.

Attorney General Eric H. Holder Jr. now says the Justice Department may not pursue criminal cases against big banks because filing charges could “have a negative impact on the national economy, perhaps even the world economy.”

“In other words,” Sanders said, “we have a situation now where Wall Street banks are not only too big to fail, they are too big to jail. That is unacceptable and that has got to change because America is based on a system of law and justice.” Read the rest of this entry →

General Electric, for example, has paid no federal income taxes for a decade while becoming a net job exporter and fighting its hard-pressed workers who want collective bargaining through unions like the United Electrical Workers Union (UE). GE’s boss, Jeffrey Immelt, makes about $12,400 an hour on an 8-hour day, plus benefits and perks, presiding over this global corporate empire.

Telling by their behavior, these big companies think patriotism toward the country where they were created and prospered is for chumps. Their antennae point to places where taxes are very low, labor is wage slavery, independent unions are non-existent, governments have their hands out, and equal justice under the rule of law does not exist. China, for example, has fit that description for over 25 years.

Other than profiteering from selling Washington very expensive weapons of mass destruction, many multinational firms have little sense of true national security. Read the rest of this entry →

Remember all that talk about leaving Afghanistan in 2014? None of it was serious.

A promise by the administration to leave Afghanistan came as recently as last October, in the vice presidential debate, when Vice President Joe Biden promised, “We are leaving… We are leaving [Afghanistan] in 2014.”

Because, according to the former commander in Afghanistan, when it comes to 2014 plans in that country, we’re not going anywhere.

Speaking to the Brookings Institution this week in Washington, DC, the retired General John Allen saidout of all the options for American forces in Afghanistan after the supposed 2014 withdraw date, the “zero option” – removing all US troops – was never really an option at all.

NATIONAL DEFENSE RESOURCES PREPAREDNESS

By the authority vested in me as President by the Constitution and the laws of the United States of America, including the Defense Production Act of 1950, as amended (50 U.S.C. App. 2061 et seq.), and section 301 of title 3, United States Code, and as Commander in Chief of the Armed Forces of the United States, it is hereby ordered as follows:

PART I  –  PURPOSE, POLICY, AND IMPLEMENTATION

Section 101Purpose.  This order delegates authorities and addresses national defense resource policies and programs under the Defense Production Act of 1950, as amended (the “Act”).

Sec. 102Policy.  The United States must have an industrial and technological base capable of meeting national defense requirements and capable of contributing to the technological superiority of its national defense equipment in peacetime and in times of national emergency.  The domestic industrial and technological base is the foundation for national defense preparedness.  The authorities provided in the Act shall be used to strengthen this base and to ensure it is capable of responding to the national defense needs of the United States.

Sec. 103General Functions.  Executive departments and agencies (agencies) responsible for plans and programs relating to national defense (as defined in section 801(j) of this order), or for resources and services needed to support such plans and programs, shall:

Lawsuit Filed Against George W Bush In California For Fabricating Iraq War

Forward to the video from roguemedia, we believe this is finally getting at what is discussed in the tab at the top of the page here, “Rico Law, Arrest The Politicians.”  It is high time that these criminal scum face a public trial, and hang for the crime of treason.  We suggest the book “U.S. v. BUSH” written by Elizabeth de la Vega, a former federal prosecutor as futher reading into this matter.  It is written out in a format that details,  with specific evidence that was available at the time of its writing, before her death, what a grand jury trial would look like if Bush were to be held accountable for his actions.

This matter is beyond any presidential pardon, or executive authority,  and in our opinion is a matter of national security,  quite possibly the only way that the United States can redeem itself in the eyes of the world in light of what our government has done..

The nation’s biggest banks wrongfully foreclosed on more than 700 military members during the housing crisis and seized homes from roughly two dozen other borrowers who were current on their mortgage payments, findings that eclipse earlier estimates of the improper evictions.

Bank of America, Citigroup, JPMorgan Chase and Wells Fargo uncovered the foreclosures while analyzing mortgages as part of a multibillion-dollar settlement deal with federal authorities, according to people with direct knowledge of the findings. In January, regulators ordered the banks to identify military members and other borrowers who were evicted in violation of federal law.

The analysis, which was turned over to regulators in recent days, provides the first detailed glimpse into the extent of wrongful foreclosures amid the collapse of the housing market. While lenders previously acknowledged that they relied on faulty documents to push through foreclosures, the banks claimed borrowers were rarely evicted by mistake, including military personnel protected by federal law.

That thesis, which underpinned the government’s response to the financial crisis, helps explain why homeowners languished for years without relief. The revelations of more pervasive harm could provide fresh ammunition for Wall Street critics and prompt regulators to adopt a tougher stance.

Housing advocates say the findings also underscore the broader flaws with the settlement. In the latest negotiations, according to people briefed on the talks, the banks secured favorable terms for doling out some aid, a deal that could diminish the relief to homeowners. Gun Control and the Politics of Opportunity in America

There have recently been a few tragic incidents involving mass shootings by what seem to be hapless and insane individuals in the U.S.  All politics and viewpoints aside,  these events are tragic, and should be avoided.  But,  not at all costs.  That solution,  “fix the problem, at all costs,”  is what is driving this country over a cliff that we will never be able to climb out of, if we keep current course.

Mentally deranged people should probably be monitored alot more than just making sure they don’t own firearms,  god forbid we allow a lunatic to pump gas and blow everyone up at the local gas-station as well.  I hope u get the point,  everything we do on a day to day basis while daydreaming of something else is dangerous.  Take driving your car for example,  most people think nothing of it.  That is most likely the single most lethal thing americans do on a day to day basis.

Gun control,  and the new fervor for passing into law some draconian ideals that are fueled by sensationalist media campaigns on the evening news should not escape anyone’s notice.  One side will argue that these [mass killings] should never happen again,  the other will argue that we need to uphold the 2nd Amendment,  both sides are right.

However,  despite the debate that ensues after every one of these incidents there are a few things to keep in mind ::

1)  Those who would sacrifice liberty for safety, deserve neither   ( Ben Franklin,  founding father of the United States of America ).   I mean no dis-respect to him when I paraphrase this to say,  ‘you are responsible for your own safety and well being,  make smart choices and keep yourself armed.’

2)  Keeping guns out of the hands of law abiding citizens only makes the problem worse,  in that case all the criminals will have guns and no one but the police state will be around to save you.

3) All of these recent incidents have numerous reports from eye witness’ that say there was more than 1 shooter.   This should raise a huge false flag to anyone that cares about the truth of the news reports they hear.

4) Mentally unstable people should probably not be allowed to have weapons that are intended to kill large amounts of people all at once.  This may actually include gasoline at filling stations,  let’s be honest.

5)  Our own government has been involved in supplying people, that most of society would view as mentally unstable, with automatic [ i.e.  illegal] weapons that EVEN NOW BEFORE NEW LEGISLATION,  CIVILIANS CAN NOT BUY OR OWN !!!!   (cough ,  cough,  Fast and the Furious Scandal, MK Ultra,  Iran Contra Scandal, not to mention the laundry list of U.S. law officers that have come forward to say that the C.I.A. is involved in a domestic drug cartel,  the list is virtually endless.)

6)  We already live in a fascist police state,  and the time to claim and hold on to your 2nd amendment rights is NOW !

7)  A smart criminal that really wanted to could build his own assault rifle,  with or without gun control,  and do the same things that have happened in these recent cases of violence.  Including building their own ammunition,  the fact is it is fairly easy,  and all the tools are available to anyone willing to take the time to do it.   If you are worried about psychopaths with automatic assault rifles,   gun control legislation will not help you.

8) After passing the recent NDAA,  which allows indefinite detainment WITHOUT TRIAL of anyone (including US citizens) the executive branch of government decides is a terrorist,  they can send you to guantanamo.   REAL FACT.   It’s current law in the U.S. after Obama’s executive order,  and that means he has every reason to disarm the populace.. .   What better time,  disarm everyone,  and then any “insurgents  (read,  people that don’t agree with the master plan )  “  can just be held in offshore prisons where we don’t have to account for anyones health, security or well being…

9) When political protest becomes illegal, and as you have seen if you are awake by now,  peaceful protest is met with violent police state, fascist style repression,  not only in the form of beating and subdueing protesters and activists…  But,  also in the form of mass media repression of the topic.  The major corporate backed news networks simply refuse to cover any protest action,  as if they can totally ignore the communication links already building within the masses.

 

The future of this planet, and our children’s children,  and those to come after depend on us..  Let’s make our voice heard,  I for one want to live on a planet that is sustainable.

20130104-national-affairs-306x-1357314071It has been four long winters since the federal government, in the hulking, shaven-skulled, Alien Nation-esque form of then-Treasury Secretary Hank Paulson, committed $700 billion in taxpayer money to rescue Wall Street from its own chicanery and greed. To listen to the bankers and their allies in Washington tell it, you’d think the bailout was the best thing to hit the American economy since the invention of the assembly line. Not only did it prevent another Great Depression, we’ve been told, but the money has all been paid back, and the government even made a profit. No harm, no foul – right?

Wrong.

It was all a lie – one of the biggest and most elaborate falsehoods ever sold to the American people. We were told that the taxpayer was stepping in – only temporarily, mind you – to prop up the economy and save the world from financial catastrophe. What we actually ended up doing was the exact opposite: committing American taxpayers to permanent, blind support of an ungovernable, unregulatable, hyperconcentrated new financial system that exacerbates the greed and inequality that caused the crash, and forces Wall Street banks like Goldman Sachs and Citigroup to increase risk rather than reduce it. The result is one of those deals where one wrong decision early on blossoms into a lush nightmare of unintended consequences. We thought we were just letting a friend crash at the house for a few days; we ended up with a family of hillbillies who moved in forever, sleeping nine to a bed and building a meth lab on the front lawn.

How Wall Street Killed Financial Reform

But the most appalling part is the lying. The public has been lied to so shamelessly and so often in the course of the past four years that the failure to tell the truth to the general populace has become a kind of baked-in, official feature of the financial rescue. Money wasn’t the only thing the government gave Wall Street – it also conferred the right to hide the truth from the rest of us. Why Big Media Shouldn’t Get Bigger and How the FCC is Doing the Opposite

In 1983, 50 corporations controlled a majority of American media. Now that number is six. And Big Media may get even bigger, thanks to the FCC’s consideration of ending a rule preventing companies from owning a newspaper and radio and TV stations in the same big city. Such a move — which they’ve tried in 2003 and 2007 as well –would give these massive media companies free rein to devour more of the competition, control the public message, and also limit diversity across the media landscape. Senator Bernie Sanders, one of several Senators who have written FCC Chairman Julius Genachowski asking him to suspend the plan, joins Bill to discuss why Big Media is a threat to democracy and what citizens can do to fight back.

OCCUPY ISN’T DEAD

DEAR CORPORATE MEDIA: OCCUPY ISN’T DEAD, BUT IF IT EVER DOES DIE, GET THE BLAME CORRECT

As I do after each one of Occupy Wall Street’s major days of action, I scoured news websites on Tuesday to learn what our “trusted watchdogs,” the mainstream media, had to say about S17.

And within minutes, I learned that the coverage – with little exception – amounted to nothing more than the typical and predictable refrain: Occupy is dead.

For me, reading Occupy stories written by reporters at the AP or Reuters or MSNBC or theDaily News or NY1 or Fox News or The New York Times is almost an exercise in masochism at this point. I don’t need to click on a link to know how the most important social movement of my lifetime is going to be handled by the establishment media. And it’s this: The coverage will fall somewhere between petulant group-think and outright falsehoods.

As a former mainstream media reporter myself – I wrote for the second-largest daily paper in New Jersey – I think I know why this is the case. Most journalists are either too meek and obedient to their most powerful sources (Mayor Bloomberg, the NYPD, etc.) to tell the real story – or they are too J-school trained to get “both sides” of the issue that they always leave the reader wondering: “So what’s the truth?” NYU professor Jay Rosen calls this “the view from nowhere.”

Throw in the fact that most mainstream media outlets are owned by huge corporations and that Occupy doesn’t fit into their neat parameters of what constitutes a political story (Democrats versus Republicans!!!), and it’s pretty obvious why every other story about the movement is an obituary.

But how many times is the mainstream media going to declare Occupy dead? It did so after encampments across the country were brutally raided and evicted late last year, it did so on Occupy’s six-month anniversary, it did so after May Day – and many more times in between.

The opening paragraph to these stories is always the same. It reads something like this: “Occupy Wall Street protesters gathered at such-and-such location yesterday, but their presence did not nearly live up to their numbers last fall.”

Enough already.

The Amber Lyon story is just the latest in a series of articles that expose the total Joseph Goebbels like censorship rampant in mainstream media today.  The first one I posted several weeks ago exposed how the NY Times basically just regurgitates whatever government officials tell them, while the other showcased how an NPR reporter covering D.C. had to leave and do her own thing out of frustration.  This is precisely why alternative media sites are taking off.  They provide the only outlets left for genuine journalism.

So back to Amber.  Back in March 2011, CNN sent a four person team to Bahrain to cover the Arab Spring.  Once there, the crew was the subject of extreme intimidation amongst other things, but they were able to record some fantastic footage.  As Glenn Greenwald of the UK’s Guardian writes in his blockbuster article from today:

In the segment, Lyon interviewed activists as they explicitly described their torture at the hands of government forces, while family members recounted their relatives’ abrupt disappearances. She spoke with government officials justifying the imprisonment of activists. And the segment featured harrowing video footage of regime forces shooting unarmed demonstrators, along with the mass arrests of peaceful protesters. In sum, the early 2011 CNN segment on Bahrain presented one of the starkest reports to date of the brutal repression embraced by the US-backed regime.

Colorado Batman shooting shows obvious signs of being staged

According to news reports, this sudden violent rampage was completely out of character for James Holmes, who was described as “shy.”

The New York Times is now reporting:
Billy Kromka, a pre-med student at the University of Colorado, Boulder, worked with Mr. Holmes for three months last summer as a research assistant in a lab of at the Anschutz Medical Campus. There is already conjecture that James Holmes may have been involved in mind-altering neuroscience research and ended up becoming involved at a depth he never anticipated. His actions clearly show a strange detachment from reality, indicating he was not in his right mind. That can only typically be accomplished through drugs, hypnosis or trauma (and sometimes all three).

The ugly realities of modern electoral politics in America hit home this week with two body blows to self-styled anti-authoritarian political networks: The Ron Paul movement finally hit the brick wall as Rand Paul (R-KY Coal Mines) endorsed Mitt Romney (R-Rich Mormon Mafia) — utterly shocking & depressing tons of semi-libertarian Republicans along with the entire conservative side of the “Truther” and/or “Liberty” movements.

Days earlier, the Wisconsin recall election against Gov. Scott Walker (R-Petulance) turned in uglier-than-expected numbers as likely thousands of Wisconsinites were stripped of their Constitutional right to vote through ridiculous new regulations — and of course a bunch of shady electronic voting machines run from a company in a suburban St. Cloud strip mall. Fox News flacks and nasty Gloria Borger/Sarah Palin types cackled that the unruly, rebellious hordes had been licked for good. Now, the Paulistas and the rebellious Cheesehead hordes must ask: what’s next?!

Perhaps these movements never had too much in common, though you could find some overlapping supporters. Probably the biggest difference is the Liberty types are pretty darn hostile to mainstream unions while the #OccupyCapitol (which the Dems transmuted into #WIrecall) clearly ended up with unions as its main hub. But they shared a hostility to the party hierarchies, business as usual, and to some extent the elite financial/War Machine domestic & international complexes, which has triggered the financial/austerity crisis by sucking out trillions of dollars. Financial Crisis at Hand

Ever since the beginning of the financial crisis and quantitative easing, the question has been before us: How can the Federal Reserve maintain zero interest rates for banks and negative real interest rates for savers and bond holders when the US government is adding $1.5 trillion to the national debt every year via its budget deficits? Not long ago the Fed announced that it was going to continue this policy for another 2 or 3 years. Indeed, the Fed is locked into the policy. Without the artificially low interest rates, the debt service on the national debt would be so large that it would raise questions about the US Treasury’s credit rating and the viability of the dollar, and the trillions of dollars in Interest Rate Swaps and other derivatives would come unglued.

In other words, financial deregulation leading to Wall Street’s gambles, the US government’s decision to bail out the banks and to keep them afloat, and the Federal Reserve’s zero interest rate policy have put the economic future of the US and its currency in an untenable and dangerous position. It will not be possible to continue to flood the bond markets with $1.5 trillion in new issues each year when the interest rate on the bonds is less than the rate of inflation. Everyone who purchases a Treasury bond is purchasing a depreciating asset. Moreover, the capital risk of investing in Treasuries is very high. The low interest rate means that the price paid for the bond is very high. A rise in interest rates, which must come sooner or later, will collapse the price of the bonds and inflict capital losses on bondholders, both domestic and foreign.

MegaFail: Prosecutors fall short on evidence against Kim Dotcom

Prosecutors in New Zealand have been unable to provide timely evidence to extradite Kim Dotcom, the founder of cloud-sharing website MegaUpload.com, to the US. The reason: there was simply too much to sift through.

­Crown attorney Fergus Sinclair said the New Zealand prosecution is unable to produce evidence by the set deadline because it is “too big a job.

They wouldn’t get a small way through it in that time,” Sinclair was quoted by Auckland Now as saying.

Prosecutors were tasked by New Zealand Judge David Harvey with rummaging through MegaUpload’s servers for evidence so that there could be a full accounting of Dotcom’s case before a decision is made on whether he is to be extradited to the US. Judge Harvey also told the FBI to collect evidence.

Dotcom’s case has been stirring controversy on both sides of the Pacific. His attorneys say the US illegally poached evidence from New Zealand, taking 18 copies of evidence despite an agreement with Kiwi prosecutors that it would remain in the country. That charge was deflected by prosecutors, who said that the clause only pertains to original data, and not copies of it, Radio New Zealand reported. NDAA 2013: Congress approves domestic deceptive propaganda

Reauthorizing the indefinite detention of US citizens without charge might be the scariest provision in next year’s defense spending bill, but it certainly isn’t the only one worth worrying about.

An amendment tagged on the National Defense Authorization Act for Fiscal Year 2013 would allow for the United States government to create and distribute pro-American propaganda within the country’s own borders under the alleged purpose of putting al-Qaeda’s attempts at persuading the world against Western ideals on ice. Former US representatives went out of there way to ensure their citizens that they’d be excluded from government-created media blasts, but two lawmakers currently serving the country are looking to change all that.

Congressmen Mac Thornberry (R-TX) and Adam Smith (D-WA) introduced “The Smith-Mundt Modernization Act of 2012” (H.R. 5736) last week during discussions for the NDAA 2013. It was voted on by the US House of Representatives to be included in next year’s defense spending bill, which was then voted on as a whole and approved. The amendment updates the antiquated Smith-Mundt Act of 1948 and Foreign Relations Authorization Act of 1987, essentially clarifying that the US State Department and the Broadcasting Board of Governors may “prepare, disseminate and use public diplomacy information abroad,” but while also striking down a long-lasting ban on the domestic dissemination in America. For the last several decades, the federal government has been authorized to use such tactics overseas to influence foreign support of America’s wars abroad, but has been barred from such strategies within the US. If next year’s NDAA clears the US Senate and is signed by President Obama with the Thornberry-Smith provision intact, then restrictions on propaganda being force-fed to Americans would be rolled back entirety. Propaganda – Manufacturing Consent, The Death of Free Press and Free Thinking

This article has come about for 2 reasons,  one being an article at beforeitsnews.com about propaganda, and secondly an article involving Tim Pool proposing a monopoly on audio broadcast during the NATO summit in the event  [like many people thought was going to happen]  that internet data transmissions went down and live video feeds were not possible.

I was going to just re-post the beforeitsnews.com article,  but felt there was alot more to say and wanted to address why we feel so strongly that even talking about a monopoly in media is enough of an offense, that it destroys the very fabric of what independent journalists working against mainstream media is all about. Not to mention what that sounds like to any journalist in a collective space where people are donating their time and energy for ZERO profit,  just for the sake of getting news out to people.

Tim Pool Seeks Monopoly on Audio Broadcast in the Event Data Services Go Down - NATO Protest 2012

Having recently worked in and around the NATO protests in Chicago, we’re surprised to learn that self professed “fair and balanced” reporter  @timcast , Tim Pool was trying to corner the market and get : A monopoly on audio broadcast in the event that data services went down and people were being prevented from live streaming.  This report was witnessed by several other individuals.

Many people, from all over the world,  thought they would be jamming or shut down internet and cellphones for months leading up to this event in Chicago, rumors had been circulating through various circles.  It seemed to many people, that it would be standard practice for an event like this where military helicopters were flying through the loop in DT Chicago between skyscrapers, just weeks in advance, on training exercises.

The rumor that was floating around among many video streamers was that data services would be down during the protest, but that cell phone service itself would remain intact.  There was a lot of speculation as to what this would mean, and many people [including Tim] involved in media efforts, were trying to figure out ways to work together towards solutions.

Tim was involved in trying to arrange for special favors, in his exact words, ”…then I could have a monopoly [on audio]…”   This would have been broadcast in the event that data services went down and live video streaming was not an option.

We can also confirm that the independent media center was told they could no longer use his [ Tim 's ] video stream to re-broadcast coverage of NATO as they had been doing from various live video feeds from everyone around the country in attendance.  There was not a single other streamer that had a problem with being re-broadcast.  In fact, most people we talked to that were uploading video live or via other means were happy to freely share, so that the whole story could be seen from multiple points of view.

I know that most of you chose the life in uniform because you love your country; because you believed in what that uniform stood for; because you wanted to serve and protect… but I also know that deep down inside you sense that something has gone terribly wrong.

You’ve watched with the rest of us as elected officials have incrementally legislated our constitutional rights away, you’ve watched as the state surveillance apparatus has expanded like a cancer through the heart of the nation, and you’ve watched as the corruption has become more and more blatant. I can understand why you haven’t wanted to acknowledge the implications of what you are witnessing. To face the reality of what is happening would mean admitting that you’ve been betrayed, and it would mean coming to terms with the fact that you… are working… for criminals.

I don’t envy your position. I know your job depends on you following orders. I know you have families to support and bills to pay, and I know that if you stand up you could loose everything… but what you need to understand is that continuing to submit to unconstitutional, and immoral orders will not protect you from what is coming. I lived in Vancouver, BC for about 2 years myself around 2005-7,  and was astonished at the fact they actually got real world news.  Something I was not used to coming from the U.S. and I commented on all the time. People there were shocked to hear when I told them what a traditional U.S. news broadcast entailed..

I told them that I have never lived in communist China,  but going off what I had heard I did not think the U.S. was much different in terms of getting real honest news reports of what was going on around the world, let alone in my own city or state.  I still feel that way today and I believe it is getting worse.

Police quietly expanding warrantless cell phone tracking

The New York Times this weekend had a feature on the dramatic growth in cell-phone tracking by law enforcement based on thousands of pages of documents obtained by the ACLU from local police departments, reporting that:

While cell tracking by local police departments has received some limited public attention in the last few years, the A.C.L.U. documents show that the practice is in much wider use — with far looser safeguards — than officials have previously acknowledged.

The issue has taken on new legal urgency in light of a Supreme Court ruling in January finding that a Global Positioning System tracking device placed on a drug suspect’s car violated his Fourth Amendment rights against unreasonable searches. While the ruling did not directly involve cellphones — many of which also include GPS locators — it raised questions about the standards for cellphone tracking, lawyers say.
