Three Motions to Dismiss Brought in Minnesota DRE Lawsuit

Last Spring, various law enforcement agencies in Minnesota worked together on picking people up and administering drugs to them.  The video showing this activity got a lot of views on Youtube.com and made national and international news.  Video shown below.

As I have covered on this blog before, some of the people who were subject to this testing brought a lawsuit against those who ran and participated in the program.

Now the State of Minnesota, Ramsey County and the “City and County Defendants” have brought three motions to dismiss this lawsuit.  This blog post is not intended in any way to be an official response to these motions, but rather as a vehicle to share these motions with the public.  Here are links to each of the memorandums of law in support of the motions to dismiss:

New Sanders Bill Would Break Up Big Banks

‘If an institution is too big to fail, it is too big to exist’


U.S. Sen. Bernie Sanders (I-Vt.) said today he will introduce legislation to break up banks that have grown so big that the Justice Department has not pursued prosecutions for fear an indictment would harm the financial system.

The 10 largest banks in the United States are bigger now than before a taxpayer bailout following the 2008 financial crisis. At the time Congress, over Sanders’ objection, approved a $700 billion bank rescue because of concerns by some that the financial institutions were too big to fail. Another $16 trillion from the Federal Reserve propped up financial institutions.

Attorney General Eric H. Holder Jr. now says the Justice Department may not pursue criminal cases against big banks because filing charges could “have a negative impact on the national economy, perhaps even the world economy.”

“In other words,” Sanders said, “we have a situation now where Wall Street banks are not only too big to fail, they are too big to jail. That is unacceptable and that has got to change because America is based on a system of law and justice.” Read the rest of this entry →

40+ Officers & ATF Agents Raid Home of Youtube Gun Personality FPSRussia

Nearly 40 law enforcement officers converged Tuesday on the property of a Franklin County man whose business partner was shot to death in January in a homicide that continues to trouble investigators.

U.S. Alcohol, Tobacco and Firearms agents supervised the raid geared at finding explosives used by Kyle Myers (AKA – FPSRussia on youtube), 26, because the ATF believes Myers may be violating a federal law regulating such explosives, according to ATF spokesman Richard Coes.

An example of one such video where FPSRussia uses tachonite,  a legal explosive that is detonated by being shot with live ammo:

Federal agents, accompanied by Georgia Bureau of Investigation agents and deputies with the sheriff’s offices in Franklin and Hart counties, raided the Royston residence of Myers. Authorities also raided on Tuesday the 60-acre farm of Lamar Myers, Kyle’s father, in Lavonia.

Cyprus Impending Economic Collapse Has Moscow On Edge

Recent events in Cyprus have turned into a widespread public protest as politicians decide how to save the small island nations banking system.  People have truned to the streets and have engaged in general strikes to protest this new and rather scary form of austerity. The measures have frozen anyone from withdrawing more than €100 per day, and will result in the freezing of any deposits greater than €130,000.  The nations banks are in trouble, and seeking a  €13billion bailout from the EU,  in turn they will need to seize a percentage of all the money deposited in the banks so that they are able to secure the bailout immediately.

A People’s Revolt in Cyprus: Richard Wolff on Protests Against EU Plan to Seize Bank Savings

The eyes of the financial world are on the small Mediterranean island of Cyprus today. The government of Cyprus has brokered a last-ditch $13 billion bailout deal with European officials to stave off the collapse of its banking sector. Under the deal, all bank deposits above approximately $130,000 will be frozen and used to help pay off the banking sector’s debts. An earlier version of the deal collapsed last week when Cypriots took to the streets to protest paying a tax of up to 10 percent on their life savings. The plan led to mass demonstrations as well as panicked bank withdrawals as Cypriots rushed to protect their savings. “It’s a demonstration of people power in this little corner of the world that’s very impressive, and the basis, I think, for some optimism about opposition,” says Richard Wolff, economics professor emeritus at University of Massachusetts, Amherst, and visiting professor at New School University. He is the author of several books including, most recently, “Democracy at Work: A Cure for Capitalism.”

Moscow hopes Cyprus won’t need its help

Russia’s Prime Minister Dmitry Medvedev said Moscow needs to study the consequences of the Cyprus bailout deal agreed in Brussels, especially for Russia. Meanwhile Vladimir Putin ordered to restructure the € 2.5 billion Cyprus loan issued in 2011.

We have to figure out what this story turns into in the long run, what the consequences for the international financial and monetary system will be – and thus, for our own interests as well,” Medvedev said in Russia’s first official reaction to the deal agreed over the weekend.

As the EU 10 billion bailout loan has been secured, First Deputy Prime Minister Igor Shuvalov, a close ally of President Vladimir Putin, said “the situation looks like no further help [for Cyprus] from the Russian government will be required.

He added that Moscow will reconsider extending the loan to Cyprus due to be repaid by 2016, after studying the full details of the Brussels package.

Lawsuit Filed Against George W Bush In California For Fabricating Iraq War

BUSH” written by Elizabeth de la Vega, a former federal prosecutor as futher reading into this matter.  It is written out in a format that details,  with specific evidence that was available at the time of its writing, before her death, what a grand jury trial would look like if Bush were to be held accountable for his actions.

This matter is beyond any presidential pardon, or executive authority,  and in our opinion is a matter of national security,  quite possibly the only way that the United States can redeem itself in the eyes of the world in light of what our government has done..

Red Lake Pipeline Protest Initiated in Northern Minnesota

#RLBlockade begins!

On the Red Lake sovereign nation land located in what is today known as northern Minnesota, an occupation has started at a location above the Enbridge-owned pipeline built without permission of the Red Lake Nation in 1949 (hashtag #RLblockade). Already a helicopter from Enbridge briefly landed next to the site (video), near the town of Leonard.

It is expected if the occupation proceeds for three days, the flow of oil – which may include controversial tar sands bitumen extracted from Alberta, Canada – will have to be shut down. The 72-hour countdown has started around roughly 3PM Thursday.

Supporters have been invited onto the site by tribal members to support the blockade, and currently volunteer media from the new UneditedMedia collective, TC Indymedia & [informally] OccupyMN are on site. Internet access appears stable enough for @uneditedcamera to periodically livestream as the camp takes shape for the long haul, also aided by mild weather. Also @samRichards10 and Robert DesJarlait (@r_desjarlait) are providing updates. Desjarlait tweeted “This isn’t a blockade, as some have reported. There is nothing to block. Drug Wars, The D.R.E. scandal, Operation Fast and Furious and Gun Control – what does this all mean in your future?

This is a call to all for assistance in investigating the facts surrounding the events detailed in the story below, if you have information, make it available. Run with it if you find something out and want a pulitzer…  there is so much more to this that no one is talking about publicly yet.

Obama paid a recent visit to Minneapolis, MN earlier this week saying he was here to promote his gun control and weapons bans stance .  The event took place,  not among the public,  but at a special facility, the Minneapolis Police Department Special Operations Center, speaking with law enforcement directly rather than the general public.

 

This is somewhat interesting considering a number of sheriffs around the country have recently voiced concerns over the legislation and executive orders, some going so far as to say they would not enforce unconstitutional laws.

The peculiar thing about this is it is reported that major players in the D.R.E. ( Drug Recognition Evaluator ) scandal , were at the conference.  This meeting comes on the heels of a major  lawsuit filed last Friday by several individuals involved in being “tested on” by police as subjects in the program.  The lawsuit aledges that police were involved in unsupervised testing,  and distribution of drugs to civilians,  with no medical supervision or regulatory commission, and then dropping them off in the street after just confirming through these tests that they were in fact intoxicated.

This article is an attempt to ask some serious questions about the connections between gun control, the fast and furious scandal, the war on drugs and how all of these tie into the D.R.E. investigation and trial.  There are some serious questions that need to be answered by policy makers and those that are serving in public office regarding these connections. After chaining myself to a speaker during a TransCanada engineer’s presentation on pipeline safety compliance at the PipeTech oil and gas pipeline conference yesterday morning, I was charged with Disrupting a Meeting or Procession. My bail was set at $500 and I was retrieved from Montgomery County Jail very early this morning by my friends in Tar Sands Blockade!
After I spent a good long time chatting it up with my arresting officer about why I do what I do and how SLAPPing me will never shut me up, I guess he passed along the good word, cause I had a more-than-hour long meeting with his department’s detectives. They assured me that they were just puzzled and not fishing for new charges – they just wanted to know what was up. Apparently, TransCanada hadn’t visited their department to warn them against so-called “eco-terrorists” like me, so they were engaged, candid and actually very concerned. The new cyberlocker service is a simplified, super-encrypted successor to Megaupload, the file-sharing site that once reputedly accounted for 4% of all internet traffic, and which US prosecutors had taken offline moments before the helicopters descended in New Zealand a year ago.

After spending almost a month in prison in early 2012, Dotcom and his co-accused were awarded bail – the first of a series of court victories that have left the prosecution case looking increasingly wobbly. With any hearing for extradition to the US to face criminal copyright charges having been pushed back, it is hard not to see the extravagant unveiling of the new site as a two-finger gesture aimed at US authorities. 2 US Judges Plead guilty to selling children to private prisons!

Penn. Judges Plead Guilty To Taking Bribes For Placing Youths in Privately Owned Jails


An unprecedented case of judicial corruption is unfolding in Pennsylvania. Several hundred families have filed a class-action lawsuit against two former judges whove pleaded guilty to taking bribes in return for placing youths in privately owned jails. Judges Mark Ciavarella and Michael Conahan are said to have received $2.6 million for ensuring juvenile suspects were jailed in prisons operated by the companies PA Child Care and a sister company, Western PA Child Care. Some of the youths were jailed over the objections of their probation officers. An estimated 5,000 juveniles have been sentenced by Ciavarella since the scheme started in 2002. We speak to two youths sentenced by Ciavarella and to Bob Schwartz of the Juvenile Law Center.

While the mainstream media has ignored the civil disobedience movement against the Keystone XL in Texas, where protesters have diligently obstructed construction of its southern leg, it’s not going to ignore this: Nebraska’s environmental agency has completed a review of a new route that ropes the pipeline through “less sensitive areas.” And it essentially gives the go-ahead. Why Big Media Shouldn’t Get Bigger and How the FCC is Doing the Opposite

And Big Media may get even bigger, thanks to the FCC’s consideration of ending a rule preventing companies from owning a newspaper and radio and TV stations in the same big city. Such a move — which they’ve tried in 2003 and 2007 as well –would give these massive media companies free rein to devour more of the competition, control the public message, and also limit diversity across the media landscape. Senator Bernie Sanders, one of several Senators who have written FCC Chairman Julius Genachowski asking him to suspend the plan, joins Bill to discuss why Big Media is a threat to democracy and what citizens can do to fight back.

MK Occupy Minnesota: The Drug Recognition Evaluator BCA Investigation files

According to all recent reports, police officers themselves indicate people were provided with drugs by law enforcement agents,  think what happens in the medical world for one second and how a Dr.’s life could be ruined in a second with one faulty prescription….
After thinking about that. realize that both Hennepin county and the city of Richfield  and  Minneapolis where this all happened,  have both refused to file criminal charges despite confirmation from law officers that they were giving people drugs with no medical supervision and letting them loose in the street afterwords.

After a 35-minute video “MK Occupy Minnesota” [produced by Occupy Minneapolis, Communities United Against Police Brutality, Rogue Media & Twin Cities Indymedia] was released documenting claims of several DRE participants they’d been given drugs and encouraged to take drugs, an officer from Hutchinson, MN, stepped forward to corroborate part of that story.

Keystone XL Pipeline Blockade – Texas

Despite being denied a permit at a national level, which is required by U.S. law.  TransCanada is continuing construction of it’s Keystone XL pipeline through Texas to the Gulf of Mexico.  The pipeline will connect the volatile and environmentally devastating tar sands of Alberta to the world market, and in the words of Bloomberg’s news drive UP the price of oil in the US.

As new pipelines including TransCanada Corp. (TRP)’s Keystone XL are built to ship oil from Canada and North Dakota to the U.S. Gulf Coast, U.S. crude prices are likely to rise, diminishing a key cost advantage for U.S. refiners and shrinking profits – bloomberg.com

People are currently putting their bodies on the line to stop this illegal construction, which TransCanada lawyers are trying to justify by getting judges in the state of Texas to sign off on evicting landowners from their land.  Something that is illegal according to U.S. law as the pipeline is intended to cross international borders and serves only private corporate interests, not the general public as certain eminent domain law arguments might be argued.  The following story  shows the environmental implications of this pipeline, shows how what TransCanada is currently doing is illegal, and details the efforts of people that are standing up to this company and it’s illegal pillaging of our fellow Americans land and rights.

From TransCanada’s own website in their own words describing the process they must comply with, and in effect admitting that on going construction is in violation of the law :

TransCanada is fully committed to the construction of the 1,897-km (1,179-mile) Keystone XL Pipeline from Hardisty, Alberta to Steele City, Nebraska. We will re-apply for a Presidential Permit and expect a new application to be processed in an expedited manner, making use of the exhaustive record compiled over the past three plus years of regulatory review to allow for an in-service date of 2015. TransCanada anticipates approval of the Presidential Permit application – which is required as the pipeline will cross the Canada/U.S. border – in the first quarter of 2013, after which construction will quickly begin.

Notice that they say construction will begin only after approval by the president, as that is legally required for this foreign company to do the work they are doing within the U.S.  This is not the case,  and as you will see in the article below they are currently involved in construction.  The company is trying to use several legal snafus that their lawyers made up to say that the state of Texas has the authority to grant permission.  They are using eminent domain laws to scare home and landowners into signing agreements that they do not agree with or condone.

Video compiled from leaked police video of events on November 15th 2011 when police violently evicted protesters from liberty square in NY.  Media was not allowed to cover the event, several journalists were arrested during the event, their video and equipment being damaged or destroyed in blatent police attempts at media repression.  Journalists were told they could not be anywhere near the park as the eviction took place…  removing any sense to the officers involved that they would be held accountable for their actions.

The Convention is where delegates are meant to cast votes for the nominee, yet the Tampa Bay Times Forum was already plastered with embedded Romney banners, and additional signs for people to hold were also smuggled in to make it appear that many are behind him. All Ron Paul material was promptly confiscated.

Ron Paul was going to be nominated on the floor after acquiring a majority of delegates from five states, but the RNC had a quick meeting in the morning and was able to change the rules last minute and raised the qualification to eight states. A busload of delegates was kidnapped preventing their key input in to the early morning ruling.

Rather than taking proper vote counts or listening to objections, several votes were clearly not unanimous, but this didn’t stop the RNC “leaders” from ignoring the dissent. Ron Paul’s name and delegate totals were not allowed to be mentioned officially on the stage, even when he won the specific state.
